ELIGATBILITY

This Olo by Case-Mate “World’s Best Naked Salesperson” Video Contest is open to legal residents of the United States and District of Columbia. You must be at least 18 years of age at time of entry. Employees and their immediate families (i.e., parents, spouses, children, siblings, grandparents, step parents, step children and step siblings, and their respective spouses, regardless of where they reside) of Case-Mate, Inc. (“Case-Mate”), YouTube.com  (“YouTube”), and each of their respective parents, affiliated companies, sponsors, subsidiaries, advertising agencies and third party fulfillment agencies, and their respective agents, employees, officers, directors, successors and assigns (the “Offering Parties”) are not eligible to win this Contest.  By participating in this Contest, you agree: (a) to be bound by these Official Rules and by the interpretations of these Official Rules by Case-Mate and by the decisions of Case-Mate, which are final and binding in all matters relating to the Case-Mate Contest; (b) to release and hold harmless the Offering Parties against any and all claims, injury or damage arising, in whole or in part, directly or indirectly, out of or relating to your participation in this Contest and/or use or misuse or redemption of the Grand Prize (as hereinafter defined) (including any travel or activity related thereto); and (c) acknowledge compliance with these Official Rules and the decisions of Case-Mate, which are final and binding.  Your participation in the Case-Mate Contest is subject to all applicable national, federal, state and local laws.

 

ENTRY PERIOD:

The Olo by Case-Mate “World’s Best Naked Salesperson” YouTube Video Contest (the “Case-Mate Contest”) COMMENCES at 12:00:01 a.m. Eastern Standard Time (“EST”) on April 19, 2013 and ENDS at 11:59:59 a.m. EST on June 14, 2013 (the “Contest Period”).  All entries must be received by 11:59:59 p.m. EST on June 14, 2013 to be eligible.

 

TO ENTER:

To enter you must follow these steps during the entry period:

  1. You must have a YouTube account or create a Youtube account in order to participate in the contest.  If you are already currently a member of YouTube, please proceed to Step 3.
  2. Create a YouTube account at www.youtube.com.  YouTube membership is not guaranteed by Case-Mate.
  3. Once you have secured a YouTube account, upload your video with the title “World’s Best Naked Salesperson” and use hashtag “#NakedTough” in the description of your video. Multiple entries per person are permitted. ENTRIES THAT CONTAIN NUDITY OR VULGARITY WILL BE AUTOMATICALLY DISQUALIFIED.
  4. Once you have completed uploading your video, enter by going to go to *http://www.case-mate.com/olo/nakedtoughvideocontest* (the "Contest Landing Page") and follow the instructions provided to submit an online entry form for the Contest ("Entry Form") including a URL for the Submission of your YouTube video.

 

You must complete the entry process fully and accurately with all required information in accordance with these Official Rules.  Entry information will be reproduced exactly as submitted if you are selected as a winner.  Case-Mate isn’t responsible for incorrect, illegible or incomplete information in giving credit for a submission.

 

By entering the “Case-Mate Contest,” you acknowledge and agree to the terms of Case-Mate’s Privacy Policy and Terms of Use when submitting the online entry as instructed.  Incomplete or inaccurate entries are void.  Each online entry submitted in accordance with these Official Rules are hereinafter referred to as an “Online Entry” or collectively, the “Online Entries”. 

Additionally, by registering at the online entry site and entering the Case-Mate Contest, you further agree to abide by and be bound by the YouTube Privacy Policy and Terms of Service, which can be found at http://www.google.com/intl/en/policies/privacy/ and http://www.youtube.com/t/terms. If you do not agree to the Privacy Policy and Terms of Use, you should not enter the Case-Mate Contest or otherwise use the entry site.

 

The Online Entries submitted in accordance with these Official Rules are each referred to hereinafter as an “Eligible Entry” or collectively as the “Eligible Entries”. In the event of a dispute over who submitted a winning Eligible Entry, the authorized account holder of the winning email account used to participate in the Case-Mate Contest at the actual time of entry will be deemed the entrant and he or she must comply with these Official Rules.  The “authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational, government, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  Proof that you submitted an entry to enter the Case-Mate Contest (regardless of method of entry) does not constitute proof or evidence that Case-Mate actually received it within the Contest Period.  All entries become the property Case-Mate and will not be acknowledged or returned. The odds of winning will be determined by the total number of Eligible Entries received.  Incomplete or inaccurate entries are void and will not be considered for participation in the Case-Mate Contest.

 

JUDGING AND SELECTION CRITERIA

The Judges, as determined by Case-Mate, will judge all Eligible Entries based on the following criteria: creativity (50%), and best usage of Naked Tough features (50%).  The Judges will then select 10 finalists videos to be voted on by the consumer audience.  One eligible contest submission will be selected by the audience and announced online on or around July 1, 2013 as the Grand Prize Winner and one other submission will be selected as the runner up winner and announced at that time as well.  In the event of a tie for any potential winning submission, the Judges score for creativity will act as a tiebreaker.

 

PRIZES

One eligible participant that submitted the Winning Submission, as determined by the Judges pursuant to the Judging section above, will be the Grand Prize winner (the “Grand Prize Winner") and receive the Grand Prize of a Five-Thousand US Dollars (US$5000) VISA International Gift Card.  One second place winner, as determined by the Judges pursuant to the Judging section above, will be awarded an iPhone 5 or Galaxy S4 (winner must choose device preference) and a collection of Olo cases for that device (cases to be determined by Case-Mate).

 

WINNER NOTIFICATION/ACCEPTANCE:

One Grand Prize Winner and one runner up winners will be announced on or around July 1, 2013 by Case-Mate.

 

Case-Mate will make up to 2 attempts over the 48 hour period following the Grand Prize Winner selection to contact the potential Grand Prize Winner via the phone number or email address provided on his/her entry.  If a potential Grand Prize Winner or second place winner cannot be reached directly during the 48 hour period in which he/she is called or does not respond to the email, the potential Grand Prize Winner or second place winner will be disqualified and, at Case-Mate’s sole discretion and time permitting, an alternate Grand Prize Winner or second place winner may be selected from among the remaining applicable Eligible Entries received.  Case-Mate expressly reserves the right to delay the announcement (if at all) of the Grand Prize Winner for creative or technical reasons or for any other reason Case-Mate deems necessary.  Winners may waive their right to receive prizes.  Prizes are nonassignable and nontransferable.  No substitutions allowed.

 

GRAND PRIZE WINNER VERIFICATION:

The potential Grand Prize Winners must prove eligibility, including, without limitation, proof of age and residence within 3 days of Grand Prize Winner being notified as the potential Grand Prize Winner.  In the event of non-compliance by the potential Grand Prize Winner, such potential Grand Prize Winner shall be disqualified and all privileges otherwise due as the Grand Prize Winner shall be terminated and an alternative potential Grand Prize Winner may be chosen from among all of the remaining applicable Eligible Entries received, if time permits, in Case-Mate’s sole discretion.

 

The Grand Prize Winner must sign within 3 days of receipt of the following documents from Case-Mate: (a) an affidavit of eligibility and release of the Offering Parties from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Contest or the use/misuse or acceptance of the Grand Prize or any portion thereof to be eligible for the Grand Prize; (b) except where prohibited by law, a promotional release granting the Offering Parties and their respective designees the right to use his/her name, address (city and state), photograph, voice and/or other likeness, prize information and contest design for sale, advertising, trade and promotional purposes without additional compensation in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval; and (c) any other documentation required by Case-Mate, including a Grand Prize Winner’s tax identification number for income tax reporting purposes (collectively, the “Releases”).

 

Entry into this Contest constitutes agreement to sign such Releases.  The Grand Prize Winner must also complete any additional legal documents provided by Case-Mate (or a third party on its behalf, if applicable) with respect to the Grand Prize and return them as instructed within the time frame specified by Case-Mate or Grand Prize Winner may forfeit Grand Prize at Case-Mate’s sole discretion.  Failure to return all such documents and comply with deadline, noncompliance with these Official Rules or the return of any prize or prize notification will result in disqualification and selection of an alternate winner. All decisions of the Case-Mate judges relating to the Case-Mate Contest are final.

 

CONTENT RESTRICTIONS:

Participants must not include any of the following content (the "Content Restrictions") in any Eligible Entry: (i) pornography, adult-oriented content or any other sexually-explicit material; (ii) materials relating to lotteries or gambling; (iii) explicit language or content, images of violence, or promotion of illegal activities; (iv) content in violation of intellectual property rights or laws; (v) libelous, defamatory, disparaging, tortious or slanderous materials; (vi) content that denigrates, disparages or reflects negatively on the MLB Entities, their owners and employees, or the game of baseball; (vii) tobacco, alcohol or drugs; (viii) dangerous stunts; (ix) real weapons of any kind including, but not limited to, guns, knives or projectiles; (x) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by any applicable national, federal, state, or local law, ordinance, or regulation; (xi) individuals under legal age of majority without providing a signed release from parent or legal guardian; (xii) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (xiii) material that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any jurisdiction where the Eligible Entry is created.  Any Eligible Entry that does not comply with the foregoing, in the sole discretion of the Offering Parties, will be disqualified and eliminated from consideration.

 

GENERAL TERMS:

Noncompliance with these Official Rules may result in disqualification and all associated entries will be void.

 

ANY VIOLATION OF THESE OFFICIAL RULES BY THE GRAND PRIZE WINNER OR ANY BEHAVIOR BY THE GRAND PRIZE WINNER THAT WILL BRING SUCH GRAND PRIZE WINNER OR CASE-MATE INTO DISREPUTE (IN CASE-MATE’S SOLE DISCRETION) WILL RESULT IN SUCH GRAND PRIZE WINNER’S DISQUALIFICATION AS THE GRAND PRIZE WINNER OF THIS CONTEST AND ALL PRIVILEGES AS THE GRAND PRIZE WINNER WILL BE IMMEDIATELY TERMINATED.

 

The Offering Parties assume no responsibility for late, lost, stolen, incomplete, damaged, garbled, misdirected, delayed or undelivered entries; or for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest.  The Offering Parties are not responsible for any problems or technical malfunction of any telephone network or lines, cellular tower, computer online systems, cable, satellite, Internet Service Provider (ISP), wireless service provider, servers, or providers, computer equipment, software, failure of any e-mail transcription on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to you or any other person’s computer related to or resulting from participation or downloading any materials in this Contest.  The Offering Parties assume no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest.  The Offering Parties are not responsible for any network, computer, typographical, printing, human or other error in the printing of any Case-Mate Contest-related materials, administration of the Case-Mate Contest, the processing of the entries, or in the announcement of the Grand Prize and Grand Prize Winner.

 

Case-Mate reserves the right in its sole discretion to cancel, terminate, modify or suspend the Case-Mate Contest for any reason, and at any time, including, but not limited to, if the Case-Mate Contest is not capable of running as planned, including, without limitation, infection of computers with virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest.  Should the Case-Mate Contest be terminated prior to the stated expiration date, notice will be posted on Case-Mate’s website and the Grand Prize may be awarded to a Grand Prize Winner to be selected from among all non-suspect Eligible Entries received up until and or after (if applicable) the time of modification, cancellation or termination or in a manner that is fair and equitable, as determined by Case-Mate.  All interpretations of these Official Rules and decisions by Case-Mate are final.  No software-generated, robotic, programmed, script, macro or other automated entries by any means which subvert the entry process are permitted.  Case-Mate reserves the right in its sole discretion to disqualify any individual (and void all associated entries) it suspects or finds: (i) to have used a software-generated, robotic, programmed, script, macro or other automated entry; (ii) to have tampered with the entry process or the operation of this Contest; (iii) to be acting in violation of these Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (v) to have provided inaccurate information on any legal documents submitted in connection with this Contest.

 

CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CASE-MATE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CASE-MATE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.  THE GEORGIA, USA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CASE-MATE CONTEST AND THE LAWS OF THE STATE OF GEORGIA, USA, SHALL GOVERN THE CASE-MATE CONTEST WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW RULES.  EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.

 

You agree to indemnify and hold harmless the Offering Parties from any and all liability resulting or arising from participation in the Case-Mate Contest, to release all rights to bring any claim, action or proceeding against Released Parties, and hereby acknowledge that the Offering Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Grand Prize, including express warranties provided exclusively by a prize supplier that are sent along with the Grand Prize.
